Good question

"If the accuser lied under oath to the grand jury, why isn't she being charged?"

- Walter Farrell, former professor at the University of Wisconsin-Milwaukee, now a professor at the University of North Carolina at Chapel Hill

Excellent question.

Eugene Kane and Walter Farrell are trying to imply that she was not lying, because if she was, she would be charged.

Of course, they both know that the case is a lot more complicated than that, but intellectual dishonesty has always been the trademark of liberals like Farrell and Kane.
