Excellent question.
Eugene Kane and Walter Farrell are trying to imply that she was not lying, because if she was, she would be charged.
Of course, they both know that the case is a lot more complicated than that, but intellectual dishonesty has always been the trademark of liberals like Farrell and Kane.
